UM why was an employee watching instead of calling police? Why would coming into contact with seminal fluid be battery on a child? What happened to aggravated public indecency? Good point lol.

I can explain the second one though. It is the same as spitting on someone. It is battery. Assault doesn't require a physical action other than words, but battery is worse (et al. assault and battery). This charge is above public indecency so that is what will be pursued. Make sense?

Was also going to say, since he's a sub, he's going to loose all teaching rights due to this. Any charges that regard sexual issues usually means you can't teach. (I could be wrong, but I was in a teacher prep program and that's how it is in CA.)

The police actually were called. I am not sure whether the person who made the phone call was the same employee that kept an eye on the offender, but bear in mind that -- unfortunately for the poor employee who had to witness this disgusting act -- a crime must have a witness or some other proof of offense in order to report it.

I used to work in retail and we were not allowed to even approach people who were committing a crime, such as shoplifting. This is because of liability issues. The perpetrator could actually turn around and sue the business establishment if one of their employees intervened. What we were supposed to do was make sure the crime was reported and to keep a close eye on the offender until the authorities arrived. If another employee was around, one of us would step away long enough to quietly make the call while the other kept the perp within sight. The police would take a statement from us in which we described the perpetrator's actions when they arrived.

Oh sure it just won't hold up, at least it wouldn't in my State, because no actual child was battered...they won't pursue a possible charge unless it's like a loaded gun or a syringe that sort of thing. It just boggles the mind, I tell you MY child wouldn't be in any classroom with this freak.

Ya I know that Walmart policy is to leave a witness, and have a perimeter to keep people away from the area...it was a knee jerk question ya know? Just sick sick sick
