Kim, they had NO right to do that. The hospital cannot force you to have an HIV test for any reason.
Some forms of HIV testing actually has a high rate of FALSE positives due to pregnancy hormones! Actually, pregnancy is the worst time to get tested for HIV.
You had every right to refuse the test. They bullied you and I would have raised a stink.
The law cannot even test RAPE SUSPECTS without their consent. They certainly can't test pregnant women. Being a Infant/Maternal nurse I have seen doctors and even nurses try to trick people into testing (so they don't have to use Universal Precautions themselves) and it is illegal and not to mention unethical.
I refused ALL HIV testing during my pregnancies. I was not going to risk them trying to take my kid, or attempt to prevent me from breastfeeding because of a false positive test. I simply said, "No, I refuse this test." That was it.
