Illegal Sex toy states?

Contributor: lamira lamira
I think one state does, some state down south - it's illegal to sell and buy, but not to own. I read it in a magazine, but that was a few months ago. I can't imagine the law changed that quickly, especially down there.

In some places there would be political capital in retaining some laws even if they aren't enforceable.

I'm in Texas as well, but the city I'm in doesn't have any sex stores at all. Instead there is a Church on literally every street corner. It's a weird change from where I lived before, in Colorado.

Yep, I live in Alabama, smack dab in the middle of the bible belt. Trust me, with some of the uptight folks down here, we should be giving discounts across the board.

It's my understanding that the Texas ban was overturned in 2008, and that was the last major bastion of sex toy illegality. Here in Virginia it's legal to buy, sell, and own, but stores are restricted from displaying them anywhere they could be seen by minors.

A new adult store just opened in the county next to us in Georgia. We went in the other night and laughed long and loud about the signs up warning us that all items were sold strictly as novelty items. Further, because they also sell "headshop items" there was a long list of words we are not allowed to say in the store or they will kick you out, like pot, weed, bong, etc. Finally, the sign said that because all items are sold as novelty items not to ask the clerks for advice about any of the items because they cannot answer! Is that some stupidity or what?

From Wikipedia:

Until recently, many Southern and some Great Plains states banned the sale of sex toys completely, either directly or through laws regulating "obscene devices."[6] In 1999, William H. Pryor, Jr., an assistant attorney general in Alabama commenting on a case involving sex toys and discussing to what end the devices are used, was quoted as saying there is no "fundamental right for a person to buy a device to produce orgasm". A federal appeals court upheld Alabama's law prohibiting the sale of sex toys on Valentine's Day, 2007.[7]

In February 2008, a federal appeals court overturned a Texas statute banning the sales of sex toys, deeming such a statute as violating the Constitution's 14th Amendment on the right to privacy.[8] The appeals court cited Lawrence v. Texas, where the U.S. Supreme Court in 2003 struck down bans on consensual sex between gay couples, as unconstitutionally aiming at "enforcing a public moral code by restricting private intimate conduct." Similar statutes have been struck down in Kansas and Colorado.

Just ... fyi, y'all ...

Texas had a law making sex toys illegal, and the U.S. supreme court overturned the law stating it was a violation of privacy. This happened during the Bush years. Republican counties have more purchases per capita then democratic counties. Who knows why? I thought it would be the other way around.

They use a loop hole where they call them "Novely products".

Ohio also has a similar law. Just a couple years ago a woman was senteced to a year in prison for holding a dildo party.

These laws were created, and maintained, by christian groups. According to them, sex toys caused divorse, child molestation and medical problems so they are banned as obscene possesions. I can't remember which state it was but during the last presidential election, the state's house of representatives voted to KEEP their anti-sex toy law. So much for being respresentatives.

That's so friggin' ridiculous and yet so predictable. We claim we're a democratic republic but really, behind the curtains, we're a theocracy. It makes me pretty mad.

Actually, at work recently I had to explain to customers that they couldn't buy alcohol on Sunday before noon. They said, "Oh, I guess we'll go somewhere else then..."

"No, ma'am. You can't buy it anywhere before noon on Sunday in the entire state."

"What?!?!"

"Actually, further south, like in Georgia where I just moved from, you can't purchase alcohol at any time during Sunday."

"Whaaaa... Why?!"

"...Christians. It's because it's the 'holy' day of the week and separation of church and state mean nothing."

"But... does that mean we can't legally go home and drink right now if we already own it?"

"Oh Of course you can! Just don't tell those Christians."

She laughed pretty hard, thanked me, and left.

See here.
when my bf and i moved back to AZ from texas, his cop friend said you can legally own up to 6 dildos. anymore than that is illegal. so when we went on the plane, so we had to split up our vibes between 3 bags and say that 6 were mine, 6 were his, and 5 were a friends

i'd need at least 5 suit cases now...good thing i don't live in texas anymore!!!

I also live in Texas and there are SOOO many sex shops here it's almost unbelievable. I really don't believe anyone enforces any restrictions because sex is big here. There would be so many places out of business.

I'd love to see in writing about this six dildo limit, because I have more and want a lot more!

Then, when you're in court, just keep asking the judge "When I'm gonna get my dildo back, Judge? When? The fuzz took it!" They love that.

What is amazing is that in these states you can walk into any WalMart and buy a gun.

"Dildos don't kill people......guns do." Bumper sticker, maybe?

I know in some areas adult stores are by law not allowed. But I bet you anything as soon as you cross the line out of town, there is probably a sex shop next to a strip club. Same thing with Dry towns and as soon as your out of the area there is a bar.

Yes, but they are usually still sold through the "medical device" loophole or the "gag gift" loophole.

Sometimes I buy sex toys over the internet that have packaging that was obviously designed for these laws, where they have big disclaimers that it's a "gag gift only" all over it.

I remember reading a while back that a woman in Texas had been arrested for owning a vibrator. Silly, isn't it?

I'm happy to live in Pennsylvania, where just about every town has at least one sex shop. Philadelphia, where I live, has several, and that's not counting any Spencer's you might bump into.
