I definitely thing there are circumstances where someone would call him one or the other; someone familiar would directly address him as "Batman" while a stranger would call him "The Batman." For example, Superman or Robin would say, "Hay, Batman, we need to stop the Joker!" A stranger, like a civilian or criminal, would say either, "I live in The Batman's town," or "The Batman might be out tonight, so I shouldn't rob this bank." "The Batman" is a reference to the abstract idea to me.

Yes, this is what I was going to say. I think the "the" dehumanizes him and is used by people who are either afraid or don't want to fully accept his existence.
