Should a man be charged with a felony for slapping a loud kid in a movie theater?

No. A felony is a bit too harsh. He only slapped the kid. The guy (is he only 21?) only deserves about 6 - 9 months in prison, plus anger management.

I know that it's a tough call to make, but you can't let your emotions cloud your judgement, especially when the judicial system is involved. This is a misdemeanor.

This, exactly. If it were another adult, it would still be wrong, but it doesn't involve the same abuse of power. Besides, you can be fairly sure that slapping someone who's roughly the same size as you are won't do very much damage, but slapping a KID? It's just not the same action. It's the same principle that makes male on female domestic abuse so serious--women tend to be smaller, so the average man has the capacity to do a lot more arm even if he's only "a little" violent.

Also, I'm sure this isn't what you meant, but I'd just like to point out that you don't just slap your OWN children like that either. I'm inclined to say it's MORE serious if it's your own child, since it's your responsibility to protect them and discipline them without hurting them.

I think he should be charged with something,but not felony charges. Just because a kid is annoying doesn't mean you can hit them.

Did he even ask the kid to stop talking/throwing popcorn? I'm not a talkative person myself, but I've seen a lot of people in theaters who comments on the movies as they go, talk together and throw pop corn during what they think is the climax, I just ask them to stop. Anyway, don't slap people, though I'm not sure whether "felony" is too hard or not since I don't know legal babble.
(I never understood why people think it is weird to go there alone and expect silence...)

I change my mind, 6-9 months in prison sounds silly. a punishment is still necessary though, just not at a felony level.

As a parent, I definitely have to say this person deserves a felony charge. Assaulting a child isn't something you should get off lightly for. And if he honestly didn't know it was a child... then why was he hitting the person in the first place? Obviously if the kids were being that much trouble, he'd have... looked at them? Heard their voices, topics of conversation, and speech patterns? I don't really see how that's an easy mistake to make.

The SOB is damn lucky that was not my child he hit....the felony would have been the least of his damn worries!!! I am worse than a mama grizzly when it comes to my child and family.....

How should this have been handled? Talk to the parent! Then talk to theater employees. DO NOT hit another person for interfering with your movie--maybe he should have moved seats??

Violence is never the answer though I have been tempted several times in my life. The child and his mother should have been asked to leave the theater and escorted out for the bad behavior but the child should NOT have been touched by another adult. A slap is one thing but knocking a tooth loose is another...possibly the child had a loose tooth that simply fell out at that opportune moment but still, it's not right.
Should he be charged with a felony? That's a bit harsh since no permanent harm was done to the child. Still if it were my child that got hit the perpetrator would not have walked out of the theater without medical attention...and I'd be facing charges, gladly.
The good news for my community is I don't tolerate misbehavior from my children and leave them at home if they cannot sit through a movie properly. We don't throw popcorn at home and I see no reason it should be allowed elsewhere...besides the stuff is a bit expensive to be throwing around! LOL
My girls get compliments on their behavior and my two year old isn't allowed the opportunity to act up, we know what he can tolerate and push his boundaries gently so he grows and learns proper behavior easily and without the need for spanking or harsh treatment...just like we did the girls. He's more of a handful but he will learn without the need to have teeth knocked out by strangers!

Except she had to know something was going on...her child was acting up and throwing popcorn. At the very least it says she showed poor judgement. Like you said earlier I have left movies I paid good money for and wanted to see so that my children wouldn't create a hostile environment for other viewers. These types of parents are why places are instituting bans against children. For my part I never wanted my children to ever feel unwelcome in a public setting...and I succeeded because I pay attention and nip it in the bud early. Clearly this parent did not and that can very well be construed as irresponsible.

I voted yes. I'm a mother to two and I would freak out if someone slapped my kid and knocked his tooth out. However, my kids would not be screaming and throwing popcorn in a movie theater either
