I just came across this on PerezHilton (it's a guilty pleasure of mine) Miley Files Lawsuit Over Sex Doll

I've also just noticed that EF has just listed the doll as an item although it's not for sale yet Finally Miylie

I personally think that once you're famous you shouldn't be able to fight back on this stuff - it's a part of being a public figure, but that's just my opinion. What do you think?

I think she absolutely has the right to sue Pipedream. It's her likeness. She's not a porn star (though she acts like one) and she should have explicit control over the products produced that affect her career.



You don't see them making Carrie Underwood dolls or Lady Gaga dolls...they're totally slamming on her character and I'd be just as pissed.



Does Pipedream have the right to make the product? Yes. Do they have the right to use her likeness without her consent? No. (It doesn't even look like her, the doll is waay prettier.)

I guarantee if you were famous and heading in a specific direction if a product was being produced and you weren't getting a cut, you'd be pissed too.

They actually did/do make a Lady Gaga doll called Lady Gag Gag - I'm not sure if it's still in production though link

Young, dumb, and old enough for cum??? I'm sad this is even on EF. If I were her, I'd fight it too. It's not her on the package, but it does not matter. Famous or not, she has a right to fight this.

Who wrote the copy for this item? LOL! Sleazy.

I don't know much about this girl, so I can't comment on the suit. I think "you're a public figure so anyone can do any kind of parody of you they want" has it's limits.

I love Miley and I think she has a right to sue. However, I agree she'll just bring more attention to the product and probably won't win a case. There is a Lady Gaga doll, but no Selena Gomez or Taylor Swift, or anything of the like.

Actually I think once you are famous and your likeness becomes a valuable "product" off which people can make money, you absolutely should be allowed to fight back.

People create an image which is valuable to them and can be attractive to certain companies who might want to pay to use that image. But that image can be damaged by having, say, a sex-doll come out with your name attached when you are a teen pop-star and therefore your "product" and ability to sell it is diminished and you are entitled to compensation for that, under the law.

Gee, Disney sues ANYBODY's ass off if they use a likeness of ANY of their characters (I'm surprised the Yoo slipped under their radar).

I know BB King sues anybody who videos him without permission and a hefty bribe.

I think what it really comes down to as - does Miley have a copyright on her likeness? I know when I was at school, we had to sign a release form to allow our photos and any videos we're in to be used for publicity in the school district.

Sex&Lies, any commentary about copyright of appearance?

She won't necessarily turn into Lindsay. Different people make different choices and jumping to conclusions isn't really fair.

Yes, I think she should sue. It would be like someone starting a fast food chain called MacDonalld's, that uses all the same colors and similar images one associates with McDonald's and puts "McDonalds" on the sign outside but the correct "MacDonalld's" on the cash register receipts. That would so not fly.
